Part of President Obama's executive immigration actions wad declared unconstitutional by a federal judge. Tuesday U.S. District Court Judge Arthur Schwab, in Pennsylvania, stated that those immigration actions are "invalid and effectively count as "legislation" from the Executive Branch.". The judge wrote ""President Obama's unilateral legislative action violates the separation of powers provided for in the United States Constitution as well as the Take Care Clause, and therefore, is unconstitutional,".
However, it is unclear as to what will happen with this due to the fact that Schwab displayed this opinion through a criminal court case against a Honduran deported in 2005. The Honduran had already pleaded guilty to re-entry of a removed alien but the court "subsequently examined the impact of Obama's immigration actions on the case". It was left open to whether the actions may apply to this case, but it was clear that he thought of the new executive actions as unconstitutional.
